Terms of Service

Please read these terms carefully before using SkillSwypeAI. By creating an account, you agree to be bound by these terms.

These Terms of Service ("Terms") constitute a legally binding agreement between you and SkillSwypeAI (Pty) Ltd ("SkillSwypeAI", "we", "us", or "our"), governing your access to and use of the SkillSwypeAI platform at skillswypeai.com and any associated mobile applications (collectively, the "Service"). By registering for an account or using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.

1. Eligibility

To use SkillSwypeAI, you must:

  • Be at least 18 years of age
  • Have the legal capacity to enter into a binding agreement
  • Not be prohibited from using the Service under applicable law
  • Provide accurate and truthful information during registration

By creating an account, you represent and warrant that you meet all eligibility requirements.

2. Account Registration

2.1 You must register for an account to use the Service. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account.

2.2 You must provide a valid email address and verify it before accessing most features. We use email verification to ensure account authenticity.

2.3 You may register for multiple roles (Job Seeker, Recruiter, Vendor/Agency) using the same email address. Each role operates as a separate profile within the platform.

2.4 You may optionally enable two-factor authentication (TOTP) for additional account security. We recommend enabling this for all accounts.

2.5 You must notify us immediately at support@skillswypeai.com if you suspect unauthorised access to your account.

3. User Roles & Responsibilities

3.1 Job Seekers (Candidates)

  • You are responsible for the accuracy of all information in your profile, including work experience, qualifications, and skills
  • Falsifying profile information, qualifications, or work history is a violation of these Terms and may result in account termination
  • Verification documents submitted must be genuine and belong to you
  • You consent to your verified profile being visible to recruiters using the platform

3.2 Recruiters

  • You must represent a legitimate business or organisation
  • Job listings must be for genuine, existing positions
  • You must not use candidate data obtained through the platform for any purpose other than recruitment
  • You must not contact candidates outside the platform using contact information obtained through SkillSwypeAI without the candidate's consent
  • You are responsible for complying with all applicable employment and anti-discrimination laws in your jurisdiction

3.3 Vendors / Agencies

  • You must represent a legitimate staffing agency or consulting firm
  • Consultant profiles managed through the platform must have the consent of each individual consultant
  • Vendor/Agency features are currently under development and will be subject to additional terms when launched

4. Acceptable Use

You agree to use the Service only for its intended purposes: job seeking, recruiting, and professional staffing. You must comply with all applicable local, national, and international laws and regulations.

Specifically, you agree to:

  • Use the platform solely for legitimate recruitment, job seeking, or professional staffing activities
  • Provide accurate and truthful information in your profile, job listings, and all platform interactions
  • Respect the privacy and rights of other users on the platform
  • Use only payment methods that you are authorised to use
  • Not initiate unjustified chargebacks or fraudulent payment disputes
  • Not share, transfer, or resell your subscription or premium access to third parties
  • Not use the platform to collect personal data for purposes unrelated to recruitment

5. Prohibited Conduct

You may not:

  • Create fake accounts, profiles, or job listings
  • Impersonate another person or entity
  • Submit falsified verification documents
  • Scrape, crawl, or use automated means to access the platform without written permission
  • Attempt to circumvent security measures, rate limits, or access controls
  • Use the platform to send spam, unsolicited messages, or harassing communications
  • Upload malicious content, viruses, or harmful code
  • Discriminate against users based on race, gender, religion, nationality, disability, sexual orientation, or any other protected characteristic
  • Resell, redistribute, or commercially exploit platform data or features without authorisation
  • Use AI-generated content from the platform to misrepresent your qualifications or experience
  • Interfere with or disrupt the Service or its infrastructure
  • Violate the intellectual property rights of SkillSwypeAI or any third party
  • Make fraudulent payments, use stolen payment methods, or initiate unjustified chargebacks
  • Share, transfer, or resell your subscription or premium access to others

Violation of these rules may result in immediate account suspension or termination.

6. Verification Services

6.1 Voluntary Participation

SkillSwypeAI offers optional verification services including ID verification, criminal background checks, qualification validation, professional reference checks, and certification verification. Submitting documents for verification is entirely voluntary. You are not required to upload any documents to use the platform. Verified profiles receive enhanced visibility in recruiter searches, but all core platform features remain available without verification.

6.2 Third-Party Background Screening

By uploading documents and submitting them for verification on SkillSwypeAI, you acknowledge and consent to your information being processed by an approved verification provider, a leading South African background screening provider. Our approved verification provider may conduct identity verification, criminal record checks, qualification validation, and other background screening services on our behalf. Do not upload or submit documents for verification if you do not consent to background checks being conducted by an approved verification provider or our other verification partners.

6.3 Verification results are displayed as status badges on your profile (e.g., "Verified", "Pending", "Unverified"). The presence of a verification badge indicates that a check has been conducted — it does not constitute a guarantee of character, competence, or suitability for any role.

6.4 We rely on third-party services and the information you provide for verification. We are not liable for inaccuracies in verification results caused by incorrect source data, delays in third-party processing, or limitations of the verification methods used.

6.5 Recruiters and employers should conduct their own independent due diligence and not rely solely on SkillSwypeAI verification badges for hiring decisions.

6.6 Submitting fraudulent documents for verification is a serious violation that will result in immediate account termination and may be reported to relevant authorities.

6.7 Document Removal & Data Deletion

You may remove your uploaded verification documents at any time. You may also delete your entire account, which will permanently remove all your data — including verification documents, profile information, and associated records — from the platform. To delete your account, use the delete function in your account settings or email support@skillswypeai.com.

6.8 Verification Timing (Candidates)

Verification of ID, Qualifications, Certifications and Criminal Checks will only be conducted after an interview process and if the recruiter or company decides to proceed with the candidate. Once the verification process is completed, the candidate will receive a verified badge on their profile. Candidates are however welcome to upload their documents at any time for fast-tracking purposes, should an opportunity arise and they wish to have their verification process expedited.

6.9 Verification Costs (Recruiters & Companies)

All verification checks conducted through the SkillSwype(AI) platform — including ID verification, qualification validation, certification verification and criminal background checks — will be charged to the recruiter or company that initiates the verification request. Verification fees will be processed through the SkillSwype(AI) platform. Alternatively, recruiters and companies may choose to use their own verified and accredited provider to conduct the checks independently, outside of the SkillSwype(AI) platform.

7. AI-Powered Features

7.1 SkillSwypeAI provides AI-powered features including CV generation, interview preparation, job specification creation, smart search, career insights, and quote generation.

7.2 AI-generated content is provided as a tool to assist you. You are solely responsible for reviewing, editing, and approving any AI-generated content before use. We do not guarantee the accuracy, completeness, or suitability of AI-generated content.

7.3 AI features are processed using third-party AI services (Azure OpenAI). Your data is sent to these services for processing in accordance with our Privacy Policy.

7.4 AI features may be gated behind premium subscriptions. Free-tier users may see previews or limited versions of AI features.

7.5 We reserve the right to modify, limit, or discontinue AI features at any time.

7.6 AI features are subject to monthly usage quotas per user per feature. Quotas reset on the 1st of each calendar month. Current usage and remaining quota are displayed within the platform.

7.7 Specific limits depend on subscription tier and may change. Exceeding a monthly quota temporarily restricts that feature until reset. Other features and account access remain unaffected.

7.8 Circumventing quotas (multiple accounts, automated tools, API exploitation) violates these Terms and may result in suspension or termination.

8. Subscriptions & Payments

8.1 Plans & Pricing

SkillSwypeAI offers free and premium subscription tiers. Current pricing:

  • Candidate: Free (R0/month) or Premium (R53/month or R509/year)
  • Recruiter: Free (R0/month) or Premium (R495/month or R4,752/year)
  • Vendor/Agency: Premium (R809/month or R7,766/year)

All prices are in South African Rands (ZAR). Annual subscriptions include a 20% discount. Prices are subject to change with 30 days' notice to existing subscribers.

8.2 Payment Processing

Payments are processed securely by Paystack. By subscribing, you authorise Paystack to charge your selected payment method on a recurring monthly basis. We do not store your payment card details.

8.3 Billing Cycle

Subscriptions are billed monthly from the date of initial purchase. Your subscription will automatically renew at the end of each billing period unless cancelled.

8.4 Failed Payments

If a payment fails, we may retry the charge. If payment cannot be collected after reasonable attempts, your subscription may be downgraded to the free tier.

8.5 Promotional Codes

We may offer promotional or referral codes that provide discounts or free premium access for a limited period. These codes are subject to their own terms, have limited uses, and cannot be combined or exchanged for cash.

9. Refund & Cancellation Policy

9.1 Cancellation

You may cancel your premium subscription at any time through your account settings. Upon cancellation:

  • Your premium features remain active until the end of your current billing period
  • No further charges will be made to your payment method
  • Your account reverts to the free tier at the end of the billing period
  • Your profile data and content are preserved

9.2 Refunds

Refund requests are handled on a case-by-case basis. To request a refund, email support@skillswypeai.com with:

  • Your account email address
  • Transaction reference or date of charge
  • Reason for the refund request

We will review your request and respond within 7 business days. Refunds, if approved, will be processed through the original payment method via Paystack.

9.3 Grounds for Refund

Refunds may be issued in the following circumstances:

  • Duplicate charges or billing errors
  • Service was significantly unavailable during the billing period due to platform issues
  • Unauthorised charges (subject to verification)

Refunds are generally not issued for:

  • Change of mind after using premium features during the billing period
  • Failure to cancel before renewal
  • Dissatisfaction with AI-generated content (as it is a tool, not a guaranteed outcome)
  • Account termination due to violation of these Terms

10. User Content

10.1 You retain ownership of all content you upload to the platform, including profile information, documents, messages, and any other materials ("User Content").

10.2 By uploading User Content, you grant SkillSwypeAI a non-exclusive, worldwide, royalty-free licence to use, store, display, and distribute your content solely for the purpose of operating and providing the Service. This licence terminates when you delete your content or account.

10.3 You represent that you have all necessary rights and permissions to upload your User Content and that it does not infringe on any third party's intellectual property rights.

10.4 We reserve the right to remove User Content that violates these Terms, is reported as inappropriate, or is otherwise objectionable.

11. Intellectual Property

11.1 The Service, including its design, code, features, branding, logos, and documentation, is the proprietary property of SkillSwypeAI (Pty) Ltd and is protected by copyright, trademark, and other intellectual property laws.

11.2 You may not copy, modify, distribute, sell, or create derivative works based on the Service or any part thereof without our explicit written permission.

11.3 AI-generated content produced through the Service (CVs, interview questions, job specifications, etc.) may be used by you for your personal and professional purposes. However, you may not resell AI-generated content as a service.

12. Messaging & Communication

12.1 The platform provides in-app messaging between users. All messages are stored on our servers and are subject to our Privacy Policy.

12.2 You must not use the messaging system for spam, harassment, solicitation of personal information beyond what is necessary for professional recruitment, or any illegal purpose.

12.3 We reserve the right to monitor messages for compliance with these Terms and to take action against accounts that misuse the messaging system.

12.4 We may send you transactional emails related to your account (verification updates, interview notifications, password resets, billing confirmations). These are not marketing communications and cannot be opted out of while you maintain an active account.

13. Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, share, and protect your personal information. By using the Service, you consent to our data practices as described in the Privacy Policy.

14. Disclaimers

14.1 THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. WE MAKE NO WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

14.2 We do not guarantee that: the Service will be uninterrupted or error-free; verification results will be 100% accurate or complete; AI-generated content will be accurate, appropriate, or free of errors; candidates or recruiters found through the platform will be suitable for any particular role or position; any particular outcome will result from using the Service.

14.3 SkillSwypeAI is a platform that connects job seekers, recruiters, and vendors. We are not an employment agency, staffing firm, or employer. We do not participate in employment decisions and are not responsible for the actions of any user.

14.4 Any career advice, salary data, or market insights provided through the Service (including via AI features) are for informational purposes only and should not be relied upon as professional advice.

15. Limitation of Liability

15.1 TO THE MAXIMUM EXTENT PERMITTED BY LAW, SKILLSWYPE AND ITS DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, REVENUE, BUSINESS OPPORTUNITIES, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE.

15.2 Our total aggregate liability for any claims arising under these Terms shall not exceed the total amount you have paid to SkillSwypeAI in the twelve (12) months preceding the claim.

15.3 Some jurisdictions do not allow the exclusion or limitation of certain warranties or liabilities. In such cases, our liability shall be limited to the fullest extent permitted by applicable law.

16. Indemnification

You agree to indemnify, defend, and hold harmless SkillSwypeAI, its directors, officers, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any third party's rights
  • User Content you submit to the platform
  • Any employment decision made based on information obtained through the Service
  • Fraudulent or inaccurate information provided by you

17. Dispute Resolution

17.1 Informal Resolution

Before initiating any formal proceedings, you agree to first contact us at support@skillswypeai.com and attempt to resolve the dispute informally. We will make reasonable efforts to resolve your concern within 30 days.

17.2 Mediation

If informal resolution is unsuccessful, either party may propose mediation through a mutually agreed mediator. The costs of mediation shall be shared equally between the parties.

17.3 Jurisdiction

If mediation fails, disputes shall be resolved in the courts of the Republic of South Africa, unless your local consumer protection laws require a different forum. Nothing in these Terms limits your right to bring a claim in your local jurisdiction if required by law.

17.4 Time Limitation

Any claim arising out of or relating to these Terms or the Service must be filed within one (1) year from the date the cause of action arose, or the claim is permanently barred.

18. Termination

18.1 You may delete your account at any time through your account settings or by emailing support@skillswypeai.com.

18.2 We may suspend or terminate your account at our discretion if:

  • You violate these Terms or our policies
  • You submit fraudulent verification documents
  • Your account is used for illegal activities
  • We receive valid legal requests to do so
  • Your account has been inactive for an extended period (we will notify you before termination for inactivity)

18.3 Upon termination: your access to the Service will be revoked; your subscription (if any) will be cancelled with no further charges; your profile will be removed from search results; your data will be handled in accordance with our Privacy Policy data retention section.

18.4 Termination does not relieve you of any obligation to pay outstanding fees or any liability for prior violations of these Terms.

19. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of South Africa, without regard to its conflict of laws provisions. This choice of governing law does not deprive you of the protection afforded by provisions from which, by virtue of the law of your country of residence, cannot be derogated by agreement.

20. Changes to These Terms

We reserve the right to modify these Terms at any time. When we make material changes:

  • We will update the "Last updated" date at the top of this page
  • We will notify you via email or in-platform notification at least 30 days before significant changes take effect
  • Your continued use of the Service after the effective date of changes constitutes acceptance of the revised Terms
  • If you do not agree to the revised Terms, you must stop using the Service and may delete your account
